Terms of Use

These Terms of Use (“Terms”) govern your use of the Recess mobile application (“Recess”, the “App”). By downloading or using the App, you agree to these Terms. If you do not agree, do not use the App.

License

We grant you a personal, non-transferable, non-exclusive, revocable license to use Recess on Apple devices you own or control, for your own personal, non-commercial use, in accordance with these Terms and Apple’s Standard End User License Agreement, which also applies.

Subscriptions and billing

Recess offers Recess Premium, an auto-renewing subscription with a 7-day free trial, then US$39.99 per year, or the equivalent in your local currency.
Payment is charged to your Apple account at confirmation of purchase, or at the end of the free trial.
The subscription automatically renews for the same period unless you cancel at least 24 hours before the current period ends.
You can manage or cancel your subscription anytime in your device’s Settings, then your name, then Subscriptions. Deleting the App does not cancel a subscription.
Except where required by law, payments are non-refundable; refund requests are handled by Apple.

Health and safety disclaimer

Recess prompts physical activity. It is not a medical device and does not provide medical advice. Consult a physician before beginning any exercise program, especially if you have a medical condition, are pregnant, or have any concern about your ability to exercise safely. You perform all exercises at your own risk. Stop immediately and seek medical help if you feel pain, dizziness, or discomfort. Ensure you have safe, clear space and stable footing before exercising.

Acceptable use

You agree not to misuse the App, interfere with its operation, attempt to access it by any means other than the interface we provide, or use it in violation of any law. The App’s app-pausing feature applies only to your own device.

Your account

You are responsible for activity under your account and for keeping your sign-in secure. You may delete your account at any time from Settings, then Delete account, in the App.

Disclaimer of warranties

The App is provided “as is” and “as available,” without warranties of any kind, whether express or implied, including fitness for a particular purpose. We do not warrant that the App will be uninterrupted, error-free, or that app-pausing will function in all circumstances.

Limitation of liability

To the maximum extent permitted by law, we will not be liable for any indirect, incidental, special, or consequential damages, or for any loss arising from your use of, or inability to use, the App, including any injury related to physical activity.

Changes

We may modify the App or these Terms. Continued use after changes take effect constitutes acceptance of the updated Terms.

Governing law

These Terms are governed by the laws of France, without regard to conflict-of-laws rules.
